General
1. Equal Justice Limited 平義社有限公司 (‘EQJ’, ‘we’, ‘us’, ‘平義社’, or other derivatives thereof) will at all times comply with the requirements of the Personal Data (Privacy) Ordinance (Cap. 486) (the ‘Ordinance’). For the purposes of this Privacy Policy, Personal Data refers to any data from which it is practicable for the identity of the individual (the ‘data subject’) to be directly or indirectly determined and is in a form in which access to or processing of the data is practicable.
2. This statement sets out:
a. How and why EQJ collects personal data;
b. How it will be used and safeguarded; and
c. How personal data can be accessed and corrected.
3. In order to preserve the confidentiality of all personal data provided to us, EQJ maintains the following privacy principles:
a. We only collect personal data that we believe to be necessary and required to provide the services requested;
b. We may pass personal data to other companies or our agents where necessary and as permitted by applicable law in order to provide relevant services and for the effective operation of EQJ. We will not disclose personal data to any external organisation unless we have the consent of the data subject, are required to do so by applicable law and/or have previously informed the data subject that we will do so. Whilst EQJ is committed to its policy of confidentiality and without limiting the generality of the aforementioned basis on which we may disclose personal data, there may be rare instances where confidentiality cannot be maintained because the directors of EQJ (or another senior official with the authority to make such determination) determine that:
i. there is a serious risk of harm to the individual or others, and/or
ii. we hold personal data which relates to a crime or other unlawful or serious improper conduct, including child abuse.
We may be required, from time to time, to disclose personal data to Government or judicial bodies or agencies, or to regulators or other appropriate authorities. Where permitted (e.g., with regard to our legal and confidentiality obligations), we will use reasonable efforts to notify the data subject of such disclosure;
c. We strive to keep all personal data on our records accurate and up-to-date, and not to keep personal data for longer than is necessary to fulfill the purpose for which it is initially collected, unless otherwise required or permitted by applicable laws or regulations;
d. We maintain strict security systems designed to prevent unauthorised access to personal data by anyone, including our staff; and
e. All our staff and all third parties with permitted access to personal data are contractually or by other means required to observe our confidentiality obligations.
Collection and Use of your Personal Data
1. We may collect your personal data when you register to utilise our services, attend our events or meetings with us, make donations to us, register to receive our Newsletter or other marketing communications or to act as a volunteer, or when making contact through our website.
2. The personal data collected may include your name, email address, contact details and other data. Data will only be collected to the extent necessary to provide our services.
3. We may use your personal data in connection with various matters, including but not limited to:
a. provision of services for online donations, fundraising and other payment-related services;
b. provision of education, training, advice, support, social work and related services;
c. verification of your identity in connection with any transactions or services;
d. internal statistical analysis and compilation of reports and training materials;
e. provision of communications and marketing services;
f. compliance with applicable laws or guidelines or formal requests issued by regulatory or other authorities; and/or
g. collaboration with local and overseas partners, including, without limitation, any research project and other forms of collaboration to assist and promote access to justice in Hong Kong and overseas.
We may be unable to provide you with our services if you fail to supply such personal data.
4. We may provide your personal data to the following classes of persons (collectively, ‘Third Parties’):
a. any of our suppliers, agents, contractors, professional advisors or third party service providers, who, in each case, provides administrative, telecommunications, data processing, payment, debt collection, marketing or other services to EQJ in connection with EQJ’s operations;
b. researchers and collaborative partners of EQJ in Hong Kong and overseas, examples of which include, without limitation: PathFinders, Justice Without Borders, Christian Action, Help, Equal Opportunities Commission, FADWU, HKCCR, HKU, Oxford University, Columbia University. Pasundan University (collectively, “Researchers and Collaborative Partners”); and
c. any other person under a duty of confidentiality to EQJ.
With regard to the above transfers of personal data, where applicable, you consent to the transfer of your personal data outside of Hong Kong.
5. When providing personal data to Third Parties, we will:
a. Only provide the information necessary and required to provide the service or services for which the relevant Third Party is responsible on the understanding that such Third Party may only use your personal data for the exact purposes specified by us;
b. Where we consider necessary and/or desirable, provide such data in a redacted, anonymised or aggregated form; and
c. Take reasonable steps to ensure that Third Parties respect and protect your data privacy, and that your data will be deleted or rendered anonymous if we stop using their services.
6. Your visit to this website will record the server information including IP address and the pages visited. Such information will be used to prepare aggregate information about the number of visitors to this website and general statistics on usage patterns of this website. Your visit to this website will be recorded anonymously and, unless specified otherwise, we will not collect any personal information that identifies a visitor to this website..
Your Rights
1. In accordance with the Ordinance, you have the right to:
a. Require EQJ to correct any data relating to you which is inaccurate;
b. Request access to and correction of your personal data: and
c. Withdraw your consent for EQJ to use your personal data.
2. Should you wish to withdraw your consent or make a data access or correction request, please contact the Data Protection Officer using the contact details below.
3. Your right of access includes the right to obtain a copy of your personal data subject to payment of a direct and necessary fee at such rate as shall be determined by EQJ.
